Background:

Development Application No.

DA20230094

Proposed Development

Alterations and additions to the existing Woolwich Marina to expand the berthing facilities from 45 to 79 berths to enable a range of different vessel typologies

Premises

2C Margaret Street, Woolwich NSW 2110

The above matter is the subject of an appeal to the NSW Land and Environment Court in response to the Sydney North Planning Panel's refusal of Development Application DA20230094.

The Court has granted the Applicant leave to rely on further amended plans and supporting information. Broadly, the Applicant has advised that the amendments involve:

  • Reorientation of the layout and footprint of the marina including removal of the most southern arm and increased berths to the west of the existing marina;
  • A reduction in the area enclosed by the marina
  • Amendment to the lengths of boats permitted from 35m to 25m;
  • Reorientation of the gangway under the bridge to allow paddle craft under the marina and provide for accessible access to marina pontoons;
  • Changes to arrangements to moorings to be relinquished or relocated;
  • Addition of wave attenuator using existing piles;
  • Public facilities including public pump out, temporary berths for public ramp users and crane sling for persons with a disability;
  • An additional two car spaces of site; and
  • Information regarding vessels and location of habitat

As a result of the changes now proposed, the amended development proposal was placed on public exhibition, and the community was invited to review the amended proposal and make a submission.

View the amended documentation under the folder 'Amended Documentation' on the right side of this page or at https://eplanning.huntershill.nsw.gov.au/Public/PlanningRegister.aspx by searching DA20230094.

Submissions closed on Friday 27 June 2025. The applicant has submitted new amended plans in relation to Aboriginal heritage, heritage, maritime archaeology and an updated preliminary site investigation.

This information is subject to an additional notification period. The community can have their say on these amended plans now.

Contribution to legal proceedings

A petition from residents against the Woolwich Marina Proposal was tabled to Council in our Ordinary Meeting in June.

Council acknowledged the petition and will continue to contest the proposal in the Land and Environment Court due to community concern and an obligation to defend the Panel’s ruling.

Council is currently engaged in these proceedings. Legal fees to date have been substantial, $378,000, as of 11 July 2025. Proceedings are ongoing.

Council is seeking contributions from the community to assist in funding the ongoing legal proceedings. All funds raised will be securely managed and used exclusively for legal expenses for our current defence and any potential appeal.

Council will report on total contributions received and how they are applied in its annual report. Any unused contributions will be returned when the matter is resolved and after all Council’s legal fees are paid.

Hunter’s Hill Council is not registered as a Deductible Gift Recipient. Donors should seek independent legal and financial advice regarding tax, GST or any legal consequences of donating. Hunter’s Hill Council cannot provide this advice.
